Sažetak
MEĐUNARODNE VOJNE AKCIJE PROTIV „ISLAMSKE DRŽAVE U IRAKU I SIRIJI“ NA TERITORIJI SIRIJE, SA ASPEKTA PRAVNOG OKVIRA SUPROTSTAVLjANjA MEĐUNARODNOM TERORIZMU
Apstrakt: Cilj članka je analiza funkcionisanja sistema kolektivne bezbednosti UN, na primeru oružane akcije koalicije protiv „Islamske države u Iraku i Siriji“ (ISIS).
Analiza polazi od pretpostavki da terorizam ne predstavlja suo ipso pravni osnov za primenu sile prema međunarodno priznatoj državi i da nezakonita upotrebe sile protiv države predstavlja terorizam u materijalnom smislu.
Navedeno polazište iziskuje operacionalno određenje međunarodnog terorizma i prirode ISIS, kao nosioca terorizma i represivne vladavine. Međunarodno suočavanje sa pretnjom koju predstavlja ISIS podvrgnuto je analizi sa aspekta modela i pravnog okvira i prakse oružane akcije koalicije protiv ISIS.
Dobijeni rezultati pokazuju da se primenom sile, mimo Saveta bezbednosti UN, faktički prihvata ISIS kao entitet izvan postojećih država.
Nelegalna primena sile protiv suverenih država, makar iz legitimnih motiva, ukazuje na blokadu sistema kolektivne bezbednosti, što može dovesti do odgovornosti za humanitarnu krizu.
