O DOKTRINI NEDELEGACIJE U PRAVNOJ TRADICIJI SJEDINJENIH AMERIČKIH DRŽAVA
Sažetak
U članku se razmatra primena doktrine nedelegacije (Nondelegation doctrine) u pravnom poretku Sjedinjenih Američkih Država. Posle uvodnih izlaganja, prvo je ispitan ustavni osnov doktrine nedelegacije, a zatim su razmotrena osnovna stanovišta pravne nauke u pogledu problema zakonodavne delegacije. Proučavanje postanka i razvitka doktrine nedelegacije zaokruženo je analizom prakse Vrhovnog suda za vreme i posle perioda „Nju dila“. Autor zaključuje da je, prema aktuelnom pristupu Vrhovnog suda problemu zakonodavne delegacije, oživljavanje doktrine nedelegacije malo verovatno, ali da istovremeno ideja nedelegacije zakonodavnih ovlašćenja i dalje živi u jednom delu pravne nauke i sudske prakse.
