ZABRANA PROTERIVANJA (NON-REFOULEMENT) U PRAKSI USTAVNOG SUDA SRBIJE U SVETLU OPŠTEPRIHVAĆENIH PRAVILA MEĐUNARDNOG PRAVA: OD PRIHVATANJA DO NEPRIMENJIVANJA

Sažetak


Zabrana zlostavljanja predstavlja apsolutnu normu međunarodnog prava i ustavnu kategoriju čije puno poštovanje i primena u velikom delu zavise i od poznavanja i direktne primene međunarodnih standarda koji su prositekli iz prakse Evropskog suda za ljudska prava. Iz zabrane zlostavljanja proizilazi i zabrana proterivanja (non-refoulement) pojedinca na teritoriju one zemlje na kojoj mu preti rizik od zlostavljanja. Ustavni sud Republike Srbije je u nekoliko navrata odlučivao u predmetima u kojima su podnosioci ustavne žalbe tvrdili da je u odnosu na njih povređen princip non-refoulement (član 25. Ustava). Autor će kroz pravnu analizu i paralelni prikaz jurisprudencija Evropskog suda za ljudska  prava i Ustavnog suda Republike Srbije ponuditi odgovor na pitanje u kojoj meri je Ustavni sud uspeo da u svojoj praksi dosledno primeni opšteprihvaćena pravila međunarodnog prava koja se odnose na princip non-refoulement, a u kontekstu primene koncepta sigurne treće zemlje.
