Privatnost, zaštita podataka o ličnosti i digitalno doba – jedan (krivično)pravni „omnibus“

Sažetak


Ustav Republike Srbije štiti pravo na privatnost kroz nekoliko aspekata. Evropska konvencija o zaštiti ljudskih prava i osnovnih sloboda, takođe. Zakon o zaštiti podataka o ličnosti, usvojen 2018. godine, matični je u ovoj oblasti. Krivični zakonik, u skladu sa ultima ratio karakterom krivičnog prava, štiti ove podatke kada dođe do najozbiljnijih povreda, a u skladu sa Zakonikom o krivičnom postupku. Međutim, sve ovo poprima drugačiju, „digitalnu“ dimenziju sa svakodnevnom ekspanzijom nauke, tehnike i inovativnih sredstava opštenja, snimanja i slično. Razumljivo, ova tendencija zahteva izvesna prilagođavanja, kako u samim propisima, tako i u njihovom tumačenju i primeni. Autorke će u ovom radu nastojati da ukažu na bitne odredbe pomenutih propisa i njihovo sadašnje i buduće razumevanje u kontekstu digitalnog društva, sa naročitim osvrtom na krivičnopravne domete. Sve se to dodatno usložnjava razvojem veštačke inteligencije koja, po svojoj prirodi, podrazumeva upotrebu velike količine podataka. Cilj rada je da locira neke od krucijalnih elemenata u zaštiti prava na privatnost, a posebno onih koji se tiču podataka o ličnosti koji su najneposrednije vezani za čoveka, i otvori pitanje potencijalnih zakonodavnih izmena.
