Društvena reakcija na kriminalitet u digitalnoj eri – značaj digitalne kriminologije i krivičnog zakonodavstva

Sažetak


Savremeni život zasnovan na digitalizaciji utiče u značajnoj meri na karakteristike kriminaliteta koji se nalazi u fokusu digitalne kriminologije kao specifičnog pristupa u proučavanju kriminalnog fenomena u digitalnoj eri. Imajući u vidu kompleksnost fenomena u radu se ističe važnost sagledavanja pomenute problematike u svim dimenzijama. Posebno se izdvaja perspektiva žrtve zbog važnosti prevencije viktimizacije u digitalnom prostoru, a koja je usko povezana sa pitanjem adekvatne krivičnopravne reakcije. Autori ukazuju na značaj kontinuiranog praćenja rezultata istraživanja o stanju digitalnog kriminaliteta, posebno u kontekstu prepoznavanja i inkriminisanja novih oblika kriminalnog ponašanja. U digitalnoj eri se transformiše i društvena reakcija na kriminalitet, u oba svoja vida: neformalnom i formalnom. Analizirajući pojedine aspekte oba oblika društvene reakcije, autori ukazuju kako na pozitivne tako i na negativne strane te transformacije.
