БЛОКЧЕЈН КАО ПРАВНИ ФЕНОМЕН: УВОДНА РАЗМАТРАЊА
Sažetak
Тема рада су полазне основе за разматрање блокчејна као правног феномена. Настао као криптографски концепт, блокчејн данас добија на значају као оквир за управљање и контролу поступцима у различитим друштвеним областима. Рад је подељен на два дела. У првом делу дат је преглед кључних карактеристика појма блокчејна и технологија дистрибуираних деловионих књига (е. Distributed Ledger Technology-ДЛТ). Циљ овог дела рада је постављање основа за разматрање описаних феномена као правних питања, које је учињено у другом делу рада. Наведени део укључује разматрања правних дефиниција блокчејна и ДЛТ технологије, уз покушај идентификације основних pravaca i formata pravnog njihovog pravnog uobličavanja blokčejn tehnologije. Značajan delo analize posvećen je tzv. „pametnim ugovorima“: reč je o pitanju kroz koje se manifestuju i prelamaju dileme koje blokčejn aktivira u pravnom diskursu. Izlaganje je ilustrovano primerima iz selektovanih nacionalnih zakonodavstava koja regulišu blokčejn i DLT tehnologiju kao pravna pitanja.
