КЛИМАТСКЕ ПРОМЕНЕ, ВАНРЕДНЕ СИТУАЦИЈЕ И ОДГОВОР РЕПУБЛИКЕ СРБИЈЕ, ЦРНЕ ГОРЕ И ХРВАТСКЕ
Sažetak
Циљ рада је испитивање карактера веза између климатских промена и ванредних ситуација у правним системима три државе. Први део рада је посвећен односу Србије, Црне Горе и Хрватске према климатским променама и ванредним ситуацијама. Анализирају се норме закона којима се регулише област климатских промена (са становишта потенцијалне релевантности за ванредне ситуације), као и закона којима се регулише област ванредних ситуација (са становишта потенцијалне релевантности за климатске промене). У другом делу рада се указује на питање чланства Србије, Црне Горе и Хрватске у релевантним међународним уговорима. Разматра се став да питање односа између климатских промена и ванредних ситуација није регулисано на целовит начин, а везе између климатских промена и ванредних ситауција унутрашњи прописи препознају недоследно. У закључку се констатује да су везе између климатских промена и ванредних ситуација у праву препознате делимично и да постоји простор за значајно јасније одређење. Карактер веза између климатских промена и ванредних ситуација требало би посматрати у светлу развоја међународног права и специфичности правних система три државе, укључујући и њихов статус у оквиру ЕУ интеграција.
