Појмовно одређење и битна обележја концесија у праву Европске уније
Sažetak
Сажетак: Предмет правне анализе у овом раду је појмовно одређење и битна обележја концесија у праву ЕУ. Посебна пажња је усмерена ка преносу оперативног ризика, који се појављује као кључно обележје тог одређења. Разматрање је засновано на релевантној регулативи ЕУ а у значајној мери и на пракси Суда правде ЕУ која је незаобилазна у овој материји. Истовремено, анализа указује на отворена питања и недостатке у погледу нормативног стања у датој области.
У раду се изводи закључак да Директива о концесијама из 2013, по први пут, на потпунији начин, покушава да појмовно одреди концесију и утврди њена битна обележја. При том за основу свог регулисања преузима праксу Суда правде ЕУ и њене релевантне закључке. У том аутономном концепту концесија, она фактички подиже пренос оперативног ризика на ранг најважнијег обележја концесија у праву ЕУ. Но и поред значајне пажње која је посвећена овом питању, његов нормативни оквир и даље садржи отворена питања и недостатке. Посебно је то изражено у погледу непрецизности и неусаглашености правних решења. У исправљању ових недостатака главни задатак ће имати Суд правде ЕУ. Међутим, не треба испустити из вида и одређене могућности националних закона држава чланица у том погледу.
