Empirijsko istraživanje uloge međunarodnog prava u radu Saveta bezbednosti UN

Abstract


Empirijsko istraživanje međunarodnog prava predstavlja predmet sve većeg interesovanja u naučnim krugovima u svetu. U ovom radu je predstavljen primer jednog takvog istraživanja. Empirijskim istraživanjen podataka o pozicijama koje su iznete povodom upotrebe sile protiv SR Jugoslavije 1999. testirana je hipoteza o operativnoj ulozi međunarodnog prava u radu Saveta bezbednosti UN: da li je ono korišćeno u formiranju pozicija, u oceni situacije i u predlaganju njenog rešenja. U uvodnom delu rada predstavljene su osnovne odlike i razvoj empirijskog istraživanja međunarodnog prava. Potom je usledio osvrt na osnovna teorijska polazišta o ulozi međunarodnog prava. U narednimm delovima rada autor je izložio hipotetički okvir, metode i rezultate istraživanja. Na kraju, izvedeni su zaključci o rezultatim istraživanja, ali je i ukazano da je neophodno raditi na širenju i razvoju znanja koja su neophodna za sprovođene empirijskog istraživanja međunarodnog prava i otvoriti raspravu o njegovim mogćnostima i dometima u naci međunarondog prava.
