ПРИЛОГ ДЕФИНИСАЊУ ТЕСТИРАЊА ИНТЕГРИТЕТА У ПОЛИЦИЈИ – НОРМАТИВНИ АСПЕКТИ

Sažetak

Сажетак: Интегритет појединца значи његову спремност и способност да се одупре изазовима који у први план стављају личне изнад општих интересa. Са аспекта рада државних службеника који врше јавну власт, интегритет има посебан однос према корупцији – више интегритета значи мање корупције и обрнуто. Као истражни метод, тестирање интегритета се у већини случајева односи на припаднике полиције и саставни је део (нове) методологије сузбијања корупције у њеним редовима. Осим откривања коруптивних радњи и провере законитости поступања полицијских службеника, тестирањем интегритета се може проверавати и квалитет примене службених овлашћења.

Иако се у компаративном праву тестирање интегритета примењује већ неколико деценија, у српско законодавство је уведено 2016. године, доношењем Закона о полицији. Првобитно импотентна законска регулатива захтевала је брзе измене, што указује да концепт тестирања интегритета код нас није најбоље схваћен. У раду се дефинише смисао и суштина тестирања интегритета као истражне методе, одређују његови различити модалитети примене, приказује компаративна регулатива и анализирају нормативна решења у нашој земљи. Посебна пажња је усмерена на интерни и екстерни аспект примене резултата тестирања интегритета, посебно њихов значај у кривичном поступку.
