Sažetak
Posmatrano iz šire istorijske perspektive, najnoviji period ustavnog života Sjedinjenih Američkih Država rizikuje da ostane upamćen kao onaj u kojem je postupak predsedničkog opoziva korišćen neuporedivo češće nego ikada ranije. Ovo skreće pažnju na temu krivične odgovornosti predsednika, o kojoj sam Ustav ćuti. Istovremeno, čini se da zakonodavstvo i sudska praksa izbegavaju da se bave ovim važnim i prilično aktuelnim pitanjem. Pitanje da li predsednički imunitet štiti predsednika ili bivšeg predsednika od hapšenja, suđenja ili kažnjavanja za dela učinjena tokom predsedničkog mandata predstavlja posebno složenu pravnu zagonetku. Ovo je posebno važno jer se čini da tradicionalni sistem "kočnica i ravnoteža" pokazuje znake slabosti zbog politizovane procedure, posebno zato što nema čvrstih pravnih smernica ni jasnih teorijskih perspektiva na ovom planu.
