СЛОБОДА УДРУЖИВАЊА СУДИЈА У БОСНИ И ХЕРЦЕГОВИНИ
Sažetak
Слобода удруживања спада у ред фундаменталних слобода и сматра се једним од нужних елемената слободног друштва. Изолован у односу на друге чланове заједнице, појединац би имао слабе изгледе да се успјешно супротстави самовољи властодршца, или да се избори за друштвене промјене које сматра оправданим. Иако наведено право посједују и судије, природа функције коју обављају може захтијевати успостављање извјесних ограничења у погледу његовог остваривања, како би се заштитили дигнитет судијске функције и повјерење јавности у независност и непристрасност судијског дјеловања.
У првом дијелу рада биће указано на значај остваривања права на слободно удруживање носилаца судијске функције. Упозориће се на улогу коју професионалне асоцијације судија врше у очувању независности судства и унапређивању његовог положаја, као и заштити владавине права и демократског уређења. Након што буде указано на одговарајуће одредбе међународних докумената и праксу Европског суда за људска права, анализи ће бити подвргнута ограничења слободe судијског удруживања усвојена у различитим националним законодавствима (посебна пажња биће посвећена оправданости забране чланства судија у политичким партијама, као и дилемама које проистичу из чланства судија у тајним друштвима, одн. другим организацијама које дјелују на сличним основама). У другом дијелу рада, анализи ће бити подвргнут правни оквир судијског удруживања у Босни и Херцеговини.
