DIGITALIZACIJA PREKOGRANIČNE SARADNjE U KRIVIČNIM STVARIMA NA NIVOU EVROPSKE UNIJE
Sažetak
Pretpostavlja se da bi upotreba informacionih tehnologija u pravosudnom sistemu mogla da doprinese ne samo povećanju efikasnosti rada nadležnih organa i racionalizaciji krivičnog postupaka i pojedinih procesnih radnji, nego da bi takav uticaj mogla da ima i na postupke prekogranične pravosudne saradnje između nadležnih organa različitih država. Na nivou Evropske unije je u poslednjih petnaestak godina prisutno strateško opredeljenje ka stvaranju Evropskog elektronskog pravosuđa, a od skoro se razvija i koncept kooperativnog digitalnog pravosuđa. Koncept je dobio i pravni osnov 2023. usvajanjem Urebde o digitalizaciji pravosudne saradnje i pristupu pravdi u prekograničnim građanskim, privrednim i krivičnim stvarima. U ovom radu dat je prikaz nastanka i razvoja ideja koje su dovele do Uredbe i analiziran je pravni okvir, s naglaskom na saradnju u krivičnim stvarima. Takođe, u radu je pažnja posvećena i posebnom obliku prekogranične saradnje u krivičnim stvarima, a to je učešće u sudskim postupcima putem video-konferencijske veze ili drugih tehnologija za komunikaciju na daljinu, kada se pojedini učesnici u postupku nalaze na teritoriji različitih država članica, sve izvesnijoj modifikaciji krivičnog postupka u ambijentu narastajuće upotrebe informacionih tehnologija.
