STRUCTURAL AND CONTENT REFORM OF DISTANCE SELLING RULES

Abstract


The subject of the article are the rules on distance selling contained in the newly adopted Directive 2023/2673. Until the adoption of Directive 2023/2673, distance selling was regulated by the Directive 2011/83 on consumer rights and Directive 2002/65 concerning the distance marketing of consumer financial services. In order to raise the level of consumer protection and avoid unnecessary overlaps, the scope of application of Directive 2011/83 is extended to contracts on financial services, while Directive 2002/65 is repealed. Amended Directive 2011/83 introduced a separate chapter with rules that apply only to financial services contracts concluded at a distance. Content changes and amedments of the rules on the distance contracts for consumer financial services are related to the trader's obligations to provide pre-contractual information and explanations, the consumer's right to withdraw from the contract and the unfair business practices regarding the use of the online interface.

Andrej Mićović, Fakultet za hotelijerstvo i turizam u Vrnjačkoj Banji Univerziteta u Kragujevcu

Andrej Mićović is an Associate Professor at the Faculty of Hotel Management and Tourism in Vrnjačka Banja, University of Kragujevac. During his academic career he has been engaged at both international and national scientific and legislative projects (international: Jean Monnet Module for EU Consumer Law, 101127877 – CONLAW (2024 – 2026), Senior Non-Key Expert at EU4Trade Project funded by IPA Annual Action Programme for Bosnia and Herzegovina, EuropeAid/140331/DH/SER/BA [2022 – Present]; Member of the team of International Forum of Travel and Tourism Advocates cooperating with UNWTO in relation to the development of the International Code on the Protection of Tourists [2021 – Present]; Member of the Experts’ Group on the Tourists and Visitors (ODR) Project under the auspices of the Hague Conference on Private International Law [2020 – Present]; TEMPUS Project „Modernization and Harmonization of Tourism Study Programmes in Serbia“, No. 544543-TEMPUS-1-2013-1-RS-TEMPUS-JPCR; national: Project Manager of the Research Project Vrnjačka Banja Villas as Cultural Heritage Keepers, funded by University of Kragujevac and the Center for Scientific Research of the Serbian Academy of Sciences and Arts [2021 – Present]; XXI Century - Service and Service Law – 179012 and Research Program of the Faculty of Hotel Management and Tourism in Vrnjačka Banja, University of Kragujevac for the year 2020-2023, funded by the Ministry of Education, Science and Technological Development of the Republic of Serbia). 

He conducted numerous academic mobilities abroad within Erasmus+ Mobility Program and bilateral arrangements: Visiting Researcher at the Humboldt University of Berlin within Erasmus Mundus Sigma Mobility Programme (December 1, 2015 - October 1, 2016) where he conducted research on the topic Protection of Travellers in the Light of the New Package Travel Directive, under the supervision of Prof. Dr. Susanne Augenhofer; Teaching mobility at the Saimaa University of Applied Sciences, Lappeenranta, Finland (April 2019); Teaching mobility at the University of Caribbean, Cancun, Mexico (November 2018 and May 2024); Training mobility at the University of Agricultural Sciences and Veterinary Medicine, Cluj-Napoca, Romania (June 14-18, 2021); Teaching Mobility at the Faculty of Tourism and Business Logistics, Goce Delcev University, Stip, North Macedonia (May 24-28, 2021); Teaching Mobility at the Edith Cowan University, Perth, Australia (May 1-5, 2023).

He is Vice President of International Forum of Travel and Tourism Advocates - IFTTA. He is a recipient of the Gerald Heifetz award for 2017, established in the memory of one of the founders of the IFTTA, for the work in the field of Travel & Tourism Law and for the contribution to the fulfillment of the specific goals of IFTTA. 

He is Director of the Centre for Research and Education in Tourism at the Faculty of Hotel Management and Tourism in Vrnjačka Banja, University of Kragujevac. He is regular speaker at travel and tourism law conferences. He co-authored 3 textbooks on Tourism Law, Consumer Law and Commercial Law and published over a 50 publications in national and international journals and conference proceedings. He has over 10 years of research experience in the commercial law field focusing on Tourism, Consumer and Service Law.
