Određivanje organa imenovanja u Arbitraži po pravilima UNCITRAL-a: pogreške i nesavršenosti

Stranke u međunarodnoj arbitraži imaju pravo da odrede organ imenovanja koji će odabrati i imenovati arbitre u slučaju da stranke ne mogu da se sporazumeju o tome i koji će odlučivati o izuzeću arbitara. Međutim, ako stranke nemaju dovoljno iskustvo i znanje, ili jednostavno ne posvete tome dovoljno pažnje,  može se desiti da načine greške u imenovanju koje će imati za posledicu određivanje organa imenovanja koji nije neutralan. Ponekad, takođe, greške u sastavljanju odredaba kojima se određuju organi imenovanja čine te odredbe nesavršenim i nekoherentnim, što može da osujeti namere stranaka o izboru organa imenovanja i da se nepovoljno odrazi na adrbitražu u celini. U ovom radu, ispitujemo primenu arbitražnih klauzula kojima se određuju organi imenovanja na dva relativno nova primera iz prakse u kojima su bila ugovorena Arbitražna pravila UNCITRAL-a, a bilo je sporno da li Međunarodni arbitražni sud MTK (ICC) može da postupa kao organ imenovanja. Cilj ovog ispitivanja je da se utvrde problemi koji mogu nastati zbog grešaka i nesavršenosti u određivanju organa imenovanja i da se ponude rešenja.
