ZADRŽAVANJE PODATAKA U PRAKSI SUDA EVROPSKE UNIJE

Sažetak


Posedovanje tačnih, potpunih i pouzdanih relevantnih podataka o saobraćaju elektronske komunikacije i pravovremeni pristup ovlašćenih nadležnih državnih organa takvim podacima je bez sumnje korisno sredstvo u borbi protiv savremenih oblika kriminala. Iz tog razloga opravdano je da se ustanovi obaveza za pružaoce usluga elektronske komunikacije da za određeni vremenski period čuvaju određene podatke o komunikacijama u čijem ostvarivanju posreduju i da te podatke predaju na zahtev ovlašćenih organa države, kako bi ih koristili u legitimne svrhe. Iz toga razloga je 2006. usvojena Direktiva o zadržavanju podataka, koje su države članice bile dužne da prenesu u nacionalno zakonodavstvo. Međutim, zadržavanje podataka predstavlja rizik po osnovna ljudska prava i slobode, ukoliko propis koji ustanovljava ovu obavezu to čini ne poštujući suštinu prava i sloboda, pre svega prava na privatnost i prava u vezi sa obradom podataka o ličnosti, iz kog razloga je 2014. Sud Evropske unije oglasio Direktivu nevažećom. I pored ove odluke, države članice i dalje regulišu obavezu zadržavanja podataka u svojim nacionalnim propisima. U vezi sa tim, postavlja se pitanje usklađenosti ovih propisa sa osnovnim pravima i slobodama i načelima Unije. Predmet rada je analiza odluka Suda EU u vezi sa ovim pitanjem nakon poništavanja Direktive o zadržavanju podataka.
