СТАНДАРДИ БЕЗБЕДНОСТИ ХРАНЕ И ПРАВО СВЕТСКЕ ТРГОВИНСКЕ ОРГАНИЗАЦИЈЕ
Sažetak
У раду се разматра правни значај стандарда безбедности хране у праву СТО. У том оквиру, задатак је да се утврди формална нормативна основа и концептуални приступ овој материји. Предмет детаљнијих анализа ће бити битне одреднице овог приступа, а посебно процес хармонизације и статус међународних стандарда у праву СТО. Исто тако, рад има за циљ да утврди ефективне резултате правила СТО у овој области, као и њихове домашаје и ограничења а то се посебно односи на процес хармонизације и примене међународних стандарда.
У области безбедности хране, у праву СТО се путем Споразума о примени санитарних и фитосанитараних мера креира реалистичан нормативни систем заснован на правилима која осигуравају сигурност и предвидљив приступ хране на међународном тржишту, уз приоритетно поштовање здравља људи и безбедности хране. У садржинском погледу, водећа улога држава у овој области се не искључује, али се она надограђује алтернативним решењима за олакшано одвијање међународне трговине, посебо снажним подстцајем хармонизације и нормативним признањем и уређењем статуса међународних стандарда.
Иако се дати приступ СТО свакако може позитивно оценити, он није једнозначан и суочен је се ограничењима и изазовима, посебно у контексту Codex стандарда као основне међународне референтне тачке у области безбедности хране. Стога је нужно овај нормативни систем дорадити, међусобно ускладити и посебно прецизирати да би се избегле негативне имликације неодређености неких од правила, чиме би се ефективност ових правила подигла на виши ниво.
