Између правне тврђаве и неизвесности: упоредна анализа оквира избегличког права у Мађарској и Индонезији
Sažetak
Ова студија упоређује правне оквире Мађарске и Индонезије у суочавању са масовним приливом избеглица у њиховим земљама. Док је Мађарска успешно смањила број тражилаца азила кроз приступ „тврђаве“ користећи свој Закон о азилу из 2007. године, индонезијски правни оквир, као што се види у Председничкој уредби 125/2016, нема процедуре за претварање тражилаца азила у избеглице. Ово је додатно отежано одсуством процеса утврђивања статуса избеглице у Индонезији, што чини изазовом пружање помоћи све већем броју тражилаца азила који сваке године улазе у земљу. Да би се позабавила овим проблемом, Индонезија мора прво да изврши националне правне промене које одражавају њену друштвено-политичку реалност пре него што ратификује Конвенцију о избеглицама из 1951. и Протоколе из 1967. године. Насупрот томе, мађарски правни оквир, иако ефикасан у смањењу броја тражилаца азила, критикован је због тога што је рестриктиван и не поштује људска права.
