POLOŽAJ I TRETMAN OSUĐENIH SA MENTALNIM POREMEĆAJIMA U PENALNOM SISTEMU
Sažetak
Osobe sa mentalnim poremećajima mogu biti lišene slobode ukoliko su dovedene u vezu sa izvršenjem krivičnog dela. Stopa zastupljenosti osuđenih sa mentalnim poremećajima u zatvorima varira od 15% do 25%, dok je u zatvorima Srbije 2010. godine bilo 73% osuđenih sa mentalnim poremećajima. Boravkom u zatvoru, pogoršava se njihovo mentalno stanje, povećava rizik recidivizma i umanjuje mogućnost rehabilitacije. Penalni tretmani koji se praktikuju u svetu, usmereni su na kriminogene potrebe, dok u Srbiji, i pored postojanja oficijelnog instrumenta za procenu rizika, potreba i kapaciteta osuđenih za promenom, ne postoje istraživanja o primeni efektivnih tretmana u penalnim ustanovama za osuđene sa mentalnim poremećajima. Cilj rada je da se prikaže zastupljenost osuđenih sa mentalnim poremećajima u penalnom sistemu, njihov specifičan status istovremeno obolelih i osuđenih osoba, normativi kojima se uređuje njihovo sankcionisanje, specifikovani instrumenati procene rizika recidivizma i specijalizovani efektivni tretmani u inostranim penalnim sistemima prema ovoj, dvostruko stigmatizovanoj populaciji.
