МАТЕРИЈАЛНИ ПОЛОЖАЈ СУДИЈА И СУДИЈСКА НЕЗАВИСНОСТ: ПРИМЕР ЈЕДНЕ ОДЛУКЕ УСТАВНОГ СУДА СЛОВЕНИЈЕ

Sažetak
Материјални положај судија је један од елемената персоналне независности судија. Плате судија треба да буду сразмерне достојанству судијске професије и терету њихове одговорности, али истовремено да заштите судије од притисака на њихово одлучивање јер то угрожава њихову независност и непристрасност. Први део рада теоријски разматра материјални положај судија и судијску независност. У другом делу је укратко представљен материјални положај судија у српском праву. Трећи део рада је посвећен одлуци Уставног суда Словеније U-I-772/21 од 01.06.2023. године у којој се овај суд бавио овим питањем, разматрајући га из угла принципа независности судства, али и принципа поделе власти.
