Protection of the right to marry under Article 12 of the European Convention for the Protection of Human Rights and Fundamental Freedoms

Abstract


Starting with the 21st century, the European Court of Human Rights has changed the approach regarding interpretation of the right to marry protected under Article 12 of the European Convention on Human Rights. The new liberal attitude towards the content of this right has opened up opportunities for new categories of persons to enter into marriage and start a family. The question arises whether the European Court of Human Rights will continue with this trend of interpretation and what consequences could that cause for the international understanding of marriage and family.

Author Biography

Jovana Vojvodić, Univerzitet u Novom Sadu, Pravni fakultet u Novom Sadu

Jovana (Petrović) Vojvodić started her legal studies in 2013 at the Faculty of Law, University of Novi Sad. She obtained her bachelor's degree in 2017 and her master's degree  in 2018. Her master’s thesis entitled 'Violent non-state actors as a threat to international peace and security.' She is currently a PHD student at the same faculty.

During her studies, Jovana showed the biggest interest in the field of international law. Jovana is a scholar of the Ministry of Education, Science and Technological Development. She has been awarded multiple times, including Special University Awards for Academic Excellence. Jovana competed in some of the most prestigious competitions in areas of both international criminal law and human rights law. In 2016, the team she was competing with won first place in the International Criminal Court competition in the Hague. In 2019, the team she was coaching won third place in the Human Rights Law competition in Banja Luka. Together with her team members, Jovana was awarded Captain Misa Anastasijevic Award for promotion of Serbia and its education.

Jovana completed internship at Basic and Higher Court in Novi Sad, as well as at the Office of Ombudsman of Republic of Serbia. She participated in Legal clinic for Refugees and Model United Nations. Jovana has worked at State Attorney’s Office and two law firms as a legal trainee.  She is currently on maternity leave. 

Jovana speaks English fluently.
