The Objectivity of Law and Justice – Figures of the Third (Hegel, Kojève, Lévinas)

Abstract


The article deals with the figure of the Third in the philosophy of Hegel, Kožev and Lévinas, who believe that the neutral and disinterested Third (das dritte, le tiers) can explain the genesis and constitution of law and justice in general. While there are many similarities between them, the nuanced differences are very important, for example, regarding the role of the state, or the tension between morality and law. Understanding the figure of the Third can help us rethink the philosophy of law.
