ЕКСТРАТЕРИТОРИЈАЛНА НАДЛЕЖНОСТ У ПРАКСИ ЕВРОПСКОГ СУДА ЗА ЉУДСКА ПРАВА И САВРЕМЕНИ ИЗАЗОВИ

Sažetak
редмет рада јесте анализа концепта екстратериторијалне (вантериторијалне) надлежности у Конвенцији за заштиту људских права и основних слобода (ЕКЉП). Овај концепт подразумијева одговор на питање да ли се може сматрати да је особа која се налази ван територије државе под њеном надлежношћу, па самим тиме да ли јој држава-чланица ЕКЉП уопште може повриједити неко право. У чланку се прво кратко представља пракса Европског суда за људска права (ЕСЉП) поводом ове врсте надлежности. Аутор закључује да је таква пракса нејасна и неуједначена. Због тога износи три алтернативна приступа концепту екстратериторијалне надлежности, а који би били јаснији, у складу са реалношћу и више оријентисани ка заштити људских права (human rights friendly). Ријеч је о тестовима позитивних и негативних обавеза, функционалности и контроле права. Касније аутор анализира три врсте савремених изазова са којима се ЕСЉП сусреће или ће се сусретати и то у областима миграција, „зелених“ случајевa и савремених технологија. Аутор закључује да се тренутна пракса ЕСЉП у погледу ове врсте надлежности тешко може адекватно примијенити на савремене изазове који ће се јавити пред ЕСЉП. Алтернативни концепти могли би да буду лијек за такве проблеме
