PARADOKS PRINUDNOG PRISTANKA U TEORIJI DRUŠTVENOG UGOVORA

Sažetak


U ovom radu analiziramo određene preduslove koje mora ispuniti društveni ugovor da bi bio smatran validnim. Kada mi možemo jedan ustavni aranžman prihvatiti kao validan? Ovdje postoje mnoga klasična pitanja, mnoga su od njih još uvijek otvorena. Mi ćemo se fokusirati na jedno od njih: kada se ustavni ugovor može tretirati kao akt slobodne volje aktera koji tim ustavom ulaze u buduću državu? Koji je, i da li uopšte postoji neki smisao u konstrukciji „prinudnog pristanka”. Moguće su dvije ekstremne teorijske pozicije: prihvatanje bilo kog pristanka kao kredibilnog bez bilo kakvih preduslova; ili odbacivanje prinudnog pristanka na osnovu neke deontološke pretpostavke ili strukturalne/logičke tvrdnje. Ovo pitanje naročito je zaoštreno unutar oblasti konstitucionalizma koja ustav shvata kao specifičan društveni ugovor.
